Universal Proves Incompetence at Enforcing Copyright Law

Stephanie Lenz's YouTube video of her tot dancing to an old Prince song was pulled down at the request of Universal last year after the music label said that the clip infringed on its copyright. Not content with simply having Universal retract its claim, Lenz and the Electronic Frontier Foundation are out to put the squeeze on Universal for issuing a bad-faith DMCA takedown. But Universal told a judge this week that, even though the clip may in fact be "fair use," it was still "infringement" and therefore the initial takedown notice was made in good faith.

I'm sorry Universal, but Fair Use means it was legal. You admitting that it was fair use means you have dug your own grave on this one. Universal can't be punished retroactively because it turned out to be Fair Use, but there is enough case law surrounding Fair Use that it should have been obvious in the first place. Courts cannot be allowed to turn into playgrounds for deep pocket bullies to force potential Fair Use legalities out before they are ruled upon.

Federal Judge rules vonage can't sign up any new customers...

Apparently, violating patents is a bad thing. Someone had better tell Microsoft!

A federal judge today issued an injunction that would bar Internet phone company Vonage from signing up additional customers as punishment for infringing on patents held by Verizon Communications.

Vonage, of Holmdel, planned an immediate appeal.

Amicus Briefing Filed In RIAA Vs. Innocents

The RIAA is now in deep due to count them... the Electronic Frontier Foundation, the American Civil Liberties Union, Public Citizen, the ACLU of Oklahoma Foundation, and the American Association of Law Libraries. They have submitted an amicus curiae brief in support of the motion for attorneys fees that has been made by Deborah Foster in Capitol Records v. Debbie Foster, in federal court in Oklahoma. This is an important case. While it may appear to many as just one woman defending herself against several large corporate copyright plaintiffs, as the court is undoubtedly aware, this lawsuit is but one battle in the broader war the RIAA is waging against unauthorized internet copying. As a result of this war, the RIAA has wrought havoc on the lives of many innocent Americans who, like Deborah Foster, have been wrongfully prosecuted for illegal acts they did not commit for over a year despite their clear innocence and persistent denials. Using questionable methods and suspect evidence, the RIAA has targeted thousands of ordinary people around the country, including grandmothers, grandfathers, single mothers, and teenagers. In its broad dragnet of litigation, the RIAA has knowingly entangled the innocent along with the guilty, dragging them through an expensive and emotionally draining process of trying to clear their names. In deciding whether or not to grant defendant Deborah Foster's Motion For Attorneys Fees, the court should consider the broader context of the RIAA lawsuit campaign - especially the positive effect that a fee award would have on encouraging the RIAA to be more diligent in conducting its pre-suit investigations, more prompt in dismissing suits when a defendant asserts substantial claims of innocence or mistaken identity, and more responsible in asserting its legal theories. Moreover, a fee award would encourage innocent accused infringers to stand up and fight back against bogus RIAA claims, deter the RIAA from continuing to prosecute meritless suits that harass defendants it knows or reasonably should know are innocent, and further the purposes of the Copyright Act by reaffirming the appropriate limits of a copyright owner's exclusive rights.

France Supports DRM

The old anti-DRM bill that made France look good is now a law without teeth. Back to their wussy ways I see. I'll change my opinion if the law changes.

More Data Retention Laws - Violation of Privacy

These new data retention laws go beyond what the government should be doing about terrorism (such as declaring WAR with the countries that harbor them instead of draconian laws that strip our civil freedoms). Now they want internet sites to retain data. This is an OUTRAGE. This goes beyond spying, this is a HUGE invasion of privacy for EVERYONE that uses the internet. Comcast is increasing their retention to 180 days in response to this crap. I'm looking to drop them soon and go with someone else. I agree that keeping logs is important (for technical reasons alone), but to mask spying in the guise of terrorism and child porn? These are the new trump cards of the government and unless WE THE PEOPLE do something about it, it will continue.

You need to start asking yourselves if civil liberties and privacy are important to you. If they are, call up your political representation and tell them to A) stop taking away our civil liberties and personal privacy in response to terrorism and B) screw themselves.

Antiporn Bill Imposes Too Much

There is a bill floating around that will harm freedom of speech and cause many people to be thrown into jail without reason. The Bush administration backed bill wants to enforce warnings on many websites that has adult content. They talk about 15 years of prison time for not following the guidelines. This is NOT how things should work on the internet. This administration is far too concerned with its own religious agenda. DO NOT SAVE THE CHILDREN. It is up to the PARENTS to protect their own children. The more you let government parent kids, the more freedom you lose. Morons.
